Charging Network Operators Is Obliged to Submit the Workplace Opening and Operation License, Required for Including Additional Charging Stations to the Charging Network Providing Services for Electronic Vehicles, to the EMRA Until 31.07.2023.

The Amendment Regulation on the Charging Services Regulation has been entered into force with the Official Gazette dated 06.09.2022 and numbered 31945. In accordance with the provisional article included to the Charging Services Regulation, charging network operators is obliged to submit the workplace opening and operation license, which is required for including additional charging stations to their charging network providing charging services for electronic vehicles, to the Energy Market Regulatory Authority until 31.07.2023.

Regulation on Books and Records to Be Kept by Sports Clubs Has Been Entered into Force as of 07.09.2022.

The rules and procedures on books and records to be kept by sports clubs and their supreme institutions has been stipulated with to the Regulation on Books and Records to Be Kept by Sports Clubs published and entered into force with the Official Gazette dated 07.09.2022 and dated 31946. The regulation sets forth the terms and conditions on essential books, recording methods, and approval and preservation period thereof together with usage and preservation of receipts.

The Rules and Procedures on Merger and Asset Transfers of Sports Clubs Has Been Regulated.

Regulation on the Rules and Procedures Concerning Mergers and Asset Transfers of Sports Clubs has been published and entered into force with Official Gazette dated 14.09.2022 and numbered 31953. The regulation stipulates the rules and principles on merger of sports clubs and transfer of one or more branch that the club is operating in to another sports club or a sports joint stock company together with its assets and liabilities. 

Submission of LPG Autogas Franchise Agreement Declaration Becomes Obligatory in LPG Autogas Franchising License Applications.

Liquefied Petroleum Gas (LPG) Market License Regulation has been amended with the regulation entered into force with the Official Gazette dated 20.09.2022 and numbered 31959. Pursuant to the amendment, the declaration duly-signed by the parties stating that the standard agreement submitted to the EMRA by the relevant distributor license holder is the same as LPG autogas franchise agreement concluded between autogas dealer and its distributor, and including the fundamental information concerning the agreement (facility address, starting and expiration date of the contract, information on relevant parties) is required to be submitted for LPG Autogas Franchising License. Additionally, those who operates under Liquefied Petroleum Gas (LPG) Market Law and Electricity Market Law have been obliged to notify the EMRA on their standard agreements concerning their main areas of activity and the amendments thereof prior to their effective date.

Monetary Upper Limit for Applying to Consumer Arbitration Committees Is Raised to TRY 30.000.

Operation procedures of consumer arbitration committees has been re-regulated and along with other amendments, monetary upper limit for applying to consumer arbitration committees is raised to TRY 30.000 with the Regulation on Consumer Arbitration Committees published with the Official Gazette dated 21.09.2022 and numbered 31960.

Commitment and Utilization Fees that Banks Can Charge Corporate Clients Has Been Updated.

The Communiqué No. 2020/4 on the Procedures and Principles Regarding Fees that Banks Can Charge Corporate Clients has been amended with the communiqué published with the Official Gazette dated 23.09.2022 and numbered 31962. Pursuant to the amendment, the commitment fee will not exceed 0.25% of the committed loan limit for the first limit allocation, and 0.125% of the renewed limit for limit renewals. Maximum commitment fee shall be on annual basis and calculated proportionally by taking the number of months of the committed limitation period into consideration. The upper limit for utilization fees for loans will be 1,10% of the disbursed loans, except for revolving loans. For revolving loans, loan utilization fee will not exceed annual 1% of the average loan disbursement balance. The maximum loan utilization fee for loan utilizations with a maturity of less than a year will be applied by proportionally reducing the fee according to the number of days of maturity
